Surrogacy Regulation Bill 2020: Recently the Union Cabinet has approved the Surrogacy (Regulation) Bill 2020 which allows any willing woman to be a surrogate mother and proposes that widows and divorced women can also benefit from its provisions beside infertile Indian couples. <\/strong><\/h4>\n

\"SurrogacyThe story of surrogacy has not been the same in India. Surrogate birth has been a very controversial issue both ethically and legally. Surrogacy involves conception by a woman using an egg from another woman or using the surrogate\u2019s own donated egg and the sperm of the donor.\u00a0\u00a0<\/span><\/p>\n

EXPLOITATION OF WOAMN AND COMMERCIALISATION<\/strong><\/h3>\n

At a glance surrogacy seems to be an attractive option for the infertile parents to get their long desired biologically related baby. But one of the most serious challenges of surrogate mothers\u2019 contract is that they exploit women. Due to lack of proper legislation both the surrogate mother and the intended parents are exploited and the profit is usually earned by middlemen and commercial agencies.\u00a0<\/span><\/p>\n

COMMERCIAL SURROGACY AND INDIAN SOCIETY<\/strong><\/h3>\n

\"Surrogacy<\/span><\/p>\n

 <\/p>\n

The condition of commercial surrogacy in India was that of legality without legislation. It was a question that how far such legislation be accepted by Indian culture. In India surrogate mothers face high levels of social stigma and ostracism. <\/span><\/p>\n

Many surrogates spend their term of pregnancy in surrogate hostels for example- Anand town in west state of Gujarat, away from their families and communities. India emerged as one of the favourites on the list of countries to be searched by intending parents who required surrogate mothers as in developed countries these services are extremely costly.\u00a0<\/span><\/p>\n

 <\/p>\n

Surrogacy Regulation Bill 2020<\/h3>\n

\"SurrogacyThis bill allows any willing woman to be a surrogate mother and proposes that widows and divorced women can also benefit from this beside the infertile Indian couples. The bill incorporates all the recommendations made by a Rajya Sabha committee and is aimed at banning commercial surrogacy and allowing altruistic surrogacy. <\/span><\/p>\n

The bill proposes that only Indian couples with both partners of Indian origin can opt for surrogacy in the country. <\/span><\/p>\n

The bill also proposes to regulate the surrogacy by establishing the National Surrogacy Board at the central level and the State Surrogacy Board and appropriate authorities in states and union territories respectively. <\/span><\/p>\n

Other provisions are that the proposed insurance cover for surrogate mother has been increased to thirty-six months.\u00a0<\/span><\/p>\n

CONCLUSION<\/strong><\/h3>\n

\"adoption\"In the past the couples who were unable to conceive were expected to turn to adoption to achieve their dream of having a child. But nowadays with the technological inventions and advancements in science the infertile couples as well as singles and homosexual parents who want to be parents see surrogacy as an easy option. <\/span><\/p>\n

In a country like India where social stigma surrounds such a practice, and the rural women tend to fall in this trap for the amount of money, there was an urgent need to regulate the surrogacy and remove the commercialisation related to it. With the recent bill change is sure to come with control in the unethical practice.<\/span><\/p>\n
